Terms of service

These Terms set the rules for access to and use of Chimpo. By creating an account or using the Services, you agree to these Terms and our Privacy policy.

1. Agreement to these terms

These Terms of Service ("Terms") form a binding agreement between you and the Chimpo operator identified in your production deployment ("Chimpo", "we", "us", "our") governing your access to and use of our websites, apps, APIs, and related services (collectively, the "Services"). By creating an account, accessing the Services, or clicking to accept, you agree to these Terms and our Privacy policy. If you do not agree, do not use the Services.

2. Changes

We may modify these Terms at any time. We will post the updated Terms with a new "Last updated" date and, where required by law or where changes are material, provide additional notice (for example email or in-app notice). Your continued use after the effective date constitutes acceptance of the revised Terms, except where applicable law requires explicit consent.

3. Eligibility

Chimpo is an adult-only service. By creating an account or using the Services, you represent that you are legally an adult in your jurisdiction and meet the minimum age required by applicable law. In many countries this is typically at least 18, but some jurisdictions set a higher threshold. If you are below the legal age of majority where you live, you may not use the Services. You may not use the Services if you are prohibited from receiving them under applicable law or sanctions. You must provide accurate registration information and keep your account credentials confidential. You are responsible for activity under your account unless you notify us of unauthorized use in accordance with our processes.

4. The Services

Chimpo provides live video matching and related social features. We may change, suspend, or discontinue any part of the Services (including features, regions, or availability) with or without notice, subject to applicable law. We do not guarantee uninterrupted, error-free, or secure operation; the Services depend on networks, devices, and third-party infrastructure outside our control.

5. User conduct

You agree to use the Services only in compliance with these Terms, our Community guidelines, and applicable laws. Without limitation, you must not:

  • Harass, threaten, defraud, stalk, or harm other users; or encourage self-harm or violence.
  • Share, solicit, or depict sexually explicit content involving minors, or any illegal content (including child sexual abuse material). We report suspected violations to authorities as required by law.
  • Distribute malware, scrape or overload our systems, reverse engineer except where permitted by law, or circumvent security, access controls, or usage limits.
  • Impersonate others, misrepresent affiliation, or use the Services for spam, pyramid schemes, or unsolicited commercial solicitation without consent.
  • Record, capture, or redistribute others' video or audio without their consent where required by law, or in violation of our rules.
  • Use the Services in any way that violates intellectual property, privacy, or publicity rights of third parties.

6. Content and intellectual property

You retain ownership of content you submit, subject to the license below. To operate the Services, you grant Chimpo a worldwide, non-exclusive, royalty-free license to host, use, reproduce, modify, display, and distribute your content solely to provide, secure, improve, and promote the Services and to comply with law (including safety and moderation). Chimpo name, logos, and the Services' look and feel are our property or our licensors'; you may not use our marks without prior written permission except as allowed by law.

7. Moderation and enforcement

We may, but are not obligated to, monitor, review, or remove content or accounts. We may suspend or terminate access, remove matches, or restrict features if we believe you violated these Terms, pose a safety or legal risk, or if required by law. We may cooperate with law enforcement. Where an appeals process is available, we will provide instructions in-product or through support channels.

8. Third-party services

The Services may integrate authentication, video infrastructure, analytics, or payment providers. Their terms and privacy policies apply to your use of their services. We are not responsible for third-party services or content.

9. Fees

If you purchase paid features, price, billing cycle, taxes, and refund rules will be presented at checkout and in a separate billing policy or order summary. Failure to pay may result in suspension of paid features.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT VIDEO MATCHES WILL BE SAFE OR APPROPRIATE. LIVE VIDEO INVOLVES INTERACTION WITH STRANGERS; YOU USE THE SERVICES AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS; IN THOSE JURISDICTIONS OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL CHIMPO OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) A FIXED CAP IN THE CURRENCY YOU USE FOR BILLING (FOR EXAMPLE AN AMOUNT EQUIVALENT TO A MODEST FIXED SUM), EXCEPT WHERE PROHIBITED BY LAW. THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

12. Indemnification

You will defend, indemnify, and hold harmless Chimpo and its affiliates and personnel from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your content, your use of the Services, your violation of these Terms, or your violation of third-party rights.

13. Copyright and intellectual property complaints

We respect intellectual property rights. If you believe material on the Services infringes your rights, notify us at the contact points on our Contact page with enough detail to locate the material and explain your claim. We may remove or disable access and take action against repeat infringers where appropriate and consistent with applicable law. Where specific statutes (for example in the United States) require a designated agent and particular notice elements, requests should include the details required by applicable law.

14. Governing law and disputes

These Terms are governed by the laws of the jurisdiction where the Chimpo operator is established, excluding conflict-of-law rules, except where mandatory consumer-protection laws require otherwise. Courts with proper jurisdiction in that location will generally have authority over disputes, unless mandatory law requires a different forum.

15. Export and sanctions

You may not use or export the Services in violation of applicable export control or sanctions laws. You represent that you are not using the Services in a manner or from a status prohibited by those laws (for example as a restricted party or from an embargoed territory), except as authorized by law.

16. General

These Terms together with the Privacy policy and any order form constitute the entire agreement regarding the Services and supersede prior understandings. If any provision is invalid, the remainder remains in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale. Notices to you may be sent to your account email or posted in the Services.

17. Assumption of risk; other users

The Services may connect you with strangers. You assume all risks associated with interactions with other users, including offensive, unlawful, or harmful conduct, misstated identity, and personal or emotional harm. We do not endorse, screen, or guarantee the conduct of users. We are not a party to disputes between users except as required by law or where we choose to moderate. You release Chimpo and its personnel to the fullest extent permitted by law from claims, demands, and damages arising out of or connected with disputes with other users or third parties met through the Services.

18. No professional advice; not emergency services

The Services are for entertainment and social connection only. Nothing on the Services constitutes medical, legal, financial, investment, or other professional advice. The Services are not a substitute for emergency services, crisis hotlines, or law enforcement. If you are in danger, contact local emergency services.

19. No fiduciary duty

No relationship of agency, partnership, joint venture, employment, or fiduciary duty is created between you and Chimpo. We owe you only the duties expressly stated in these Terms and applicable law.

20. Force majeure

We are not liable for failure or delay in performance due to events beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network or power failures, strikes, or supplier failures.

21. No waiver of non-waivable rights

Nothing in these Terms limits any statutory rights that cannot be limited or waived under applicable consumer or other mandatory law. If a court finds any provision unenforceable, the remainder stays in effect.
